These terms and conditions (“Terms of Use”) govern your access to, and use of the online ordering website https://parts.cat.com/en/albahar HEREAFTER CALLED “PCC”. This is an agreement between you or the entity you represent (HEREAFTER CALLED “CUSTOMER”) and Mohammed Abdul-Rahman Al-Bahar (HEREAFTER CALLED “M. A. R. AL-BAHAR”)
Whereas:

  • In view of the fact that M.A.R. Al-Bahar is committed to providing customers with the best value products and services in the field and online; we have operated a website called “PCC”.
  • The primary objective of PCC is to streamline the customer experience by offering the ability to order spare parts quickly and efficiently online. PCC is not designed to serve as a comprehensive source of information for parts and services.
  • Customer wishes to become a Registered PCC Member, providing that the customer is aware of the main purpose of the PCC (mentioned in the above clause 2)

Now therefore, in consideration of the covenants contained in this agreement, both parties (Al-Bahar & the Customer) agree as follows:

1. Al-Bahar’s PCC Privacy – Customer acknowledges that he has read and agreed to Al-Bahar’s PCC Privacy Policy. (The Policy can be viewed by visiting https://www.albahar.com/dealer-agreement-2/
2. The customer confirms that the information provided during registration accurately represents them and grants authorization for the designated individual to place online orders on their behalf.
3. The Customer acknowledges that any person accessing the PCC site using their assigned username and password is authorized to act as a representative of the customer in utilizing the PCC Services. This includes full responsibility for any online orders of spare parts and checking prices and availability.
4. Ordered Parts – The customer is responsible to ensure that part numbers entered on the order screen represent his actual need. In the case that the customer is unsure and needs assistance, he should contact the PCC HOTLINE number that you can find at https://www.albahar.com/aftermarket/pcc/, or through WhatsApp chat on +971589982988
5. Financial & Payment Terms – Customers have the option to choose from various financial and payment methods when placing online orders. If they select the “Dealer Credit” option, it is mandatory for them to furnish a valid Local Purchase Order (LPO) reference. The official LPO copy must be submitted either before or upon collecting the parts.
6. In the event that the customer utilizes PCC for any purpose other than the primary objective outlined above, M.A.R. Al-Bahar reserves the right to terminate this agreement by providing a written notice one week in advance and disabling PCC access. Conversely, the customer may also choose to terminate this agreement, with or without a valid reason, by providing a written notice one week before the termination date.
7. The prices listed on the website are subject to change without notice, in accordance with adjustments made by our suppliers. It is important to note that the following items are excluded from the discount calculation: Core Deposit for REMAN Parts, SOS samples, Oil products, and any air freight charges incurred when ordering heavy non-stock items
8. Please be advised that for customers who have selected Cash/Check as their billing method, their orders will be put on hold until payment is received. If payment is not made within 24 hours of placing the order, the order will be automatically cancelled.
9. Parts that are returnable and in stock can be returned within 10 business days from the invoice date, as long as you provide proof of purchase. The returned parts will be thoroughly inspected and must be in their original, unused condition, including packaging. If the return is accepted, a Parts Credit Memo will be immediately processed and issued on the same day. Please note that shipping and delivery charges are not eligible for credit. Non-returnable and “NS” parts cannot be returned once invoiced, so we recommend consulting with your dealer counter advisors before placing your order for these items.
10. While placing an order, the customer must read carefully all the notes being mentioned at the bottom of each order screen where the following notes will be shown (as an example):
By placing an order, you agree to the terms and conditions of our order cancellation policy.

Order Cancellation Policy:

1. Customer may cancel an order within 24 hours after placing the order without any penalties and Full refund. Any cancellation request made after this period will be subject to Parts return processing fees.
2. All cancellations requests should be officially communicated, via e-mail, with our Parts customer service team at respective branch, stating the order number and reason for cancellation.
3. In case of Any BO parts cancellations due to customer’s order cancellations, a processing fees may apply based on case by case basis.
4. All processed, shipped & invoiced parts orders are not Subject for cancellations and will be handled as per our parts return policy.
5. Refunds will be processed within 48 hours of receiving the cancellation request. The refund will be processed as Cash or credit as per the original sales invoice transaction payment method.
We reserve the right to cancel any order if we suspect fraudulent activity or if we are unable to fulfill the order for any reason.

11. Governing law:
The terms and conditions outlined herein shall be governed by and construed in accordance with the laws of the GCC countries, including but not limited to the United Arab Emirates, Kuwait, Bahrain, Qatar, and Oman, without regard to any principles of conflicts of law that may otherwise apply. By agreeing to these terms and conditions, both parties, Albahar and the undersigned, agree to irrevocably submit to the exclusive jurisdiction of the courts located in the GCC countries in the event of any disputes arising out of or related to these terms and conditions. Such submission to jurisdiction shall not preclude either party from seeking injunctive relief in any other jurisdiction in order to protect its intellectual property rights or confidential information.
12. Warranty Information.

ALL Caterpillar parts carry standard warranty for a period of one year from actual Purchase (supply) date or invoice date for any manufacturing and materials defect.
